Tree Removal Permits & Ordinances in Asbury Park

Asbury Park requires approval before any tree is removed, on private property as well as public, which is stricter than most Monmouth County towns. The Environmental/Shade Tree Commission (ESTC), established under N.J.S.A. 40:56A-1 et seq., reviews applications. The ordinance was amended at the April 24, 2024 Council meeting to add removal penalties, following the NJDEP MS4 model.

Removing a tree without approval carries a fine of $500 to $2,000 per offence, and can also carry up to 30 days in county jail or up to 90 days of community service, enforced by the Asbury Park Police Department and Code Enforcement. Trees that are damaged or in poor health are exempt.

Otherwise a replacement is required, planted in the same spot, elsewhere on your property, or by paying the City to plant one elsewhere in Asbury Park. The payment is based on the size of the tree removed; $450 was the figure reported at adoption.

Street trees are separate. A written ESTC permit is required to cut, trim, break, climb with spikes, disturb roots, spray or remove any living tree on a City street. Development projects must provide one street tree per 50 feet of frontage, or contribute to the Shade Tree Commission fund.
